PRODUCTION
TERMS
These Production Terms establish general conditions applicable to productions requesting, booking, transporting, possessing, operating or otherwise using vehicles sourced or coordinated through Official Cinema Cars.
BOOKING A VEHICLE MEANS ACCEPTING THE APPLICABLE TERMS.
Additional agreements, booking confirmations, insurance requirements, owner restrictions or production-specific terms may apply to an individual vehicle or engagement.
ROLE OF OFFICIAL CINEMA CARS
A SPECIALIZED VEHICLE
SOURCING NETWORK.
Official Cinema Cars provides vehicle sourcing, registry, coordination and brokerage services connecting productions with independently owned vehicles.
Unless expressly stated otherwise in writing, Official Cinema Cars does not own the vehicles listed or represented through the OCC network.
Vehicle availability, condition, specifications and owner approval remain subject to confirmation for each individual production.
BOOKING & CONFIRMATION
REQUEST
A vehicle inquiry, search request or availability discussion does not constitute a confirmed booking.
AVAILABILITY
All vehicles remain subject to owner approval and availability for the requested production dates.
CONFIRMATION
A booking is considered confirmed only after applicable terms, rates, use, dates and required documentation have been approved.
RATES, FEES & PAYMENT
EACH BOOKING
IS DIFFERENT.
Vehicle rates may vary according to vehicle type, value, rarity, intended use, duration, production requirements, transportation and risk.
Vehicle rental or appearance fees
Transportation or towing
Mileage and fuel
Owner or vehicle attendant fees
Hold days or extended booking days
Overtime or extended production use
Storage, parking or location-related expenses
Special preparation or production requirements
Payment schedules, deposits and other financial terms may be established in the applicable booking confirmation, invoice or agreement. Production is responsible for charges associated with approved services and vehicle use.
PERMITTED VEHICLE USE
USE ONLY AS
AUTHORIZED.
A vehicle may only be used for the production activities disclosed and approved as part of the booking.
Production must disclose whether the vehicle will be static, driven, photographed, filmed, rigged, transported, used by talent, used as a hero vehicle, used as a background vehicle or subjected to any unusual production activity.
DRIVERS & VEHICLE OPERATION
NO UNAUTHORIZED DRIVERS.
No person may operate a vehicle unless vehicle operation has been approved and the driver satisfies applicable licensing, insurance and booking requirements.
Actor, talent, crew or third-party operation must be disclosed before use and may require separate approval.
The vehicle owner may require that only the owner, an owner-designated driver or another specifically approved individual operate the vehicle.
PROHIBITED USE
THE FOLLOWING ACTIVITIES
ARE NOT AUTHORIZED.
MODIFICATIONS, RIGGING & ADHESIVES
ASK BEFORE
YOU TOUCH.
Production may not alter, disassemble, drill, cut, paint, wrap, tape, attach equipment to or otherwise modify a vehicle without prior authorization.
This includes camera mounts, suction devices, adhesives, decals, vinyl, temporary graphics, lighting equipment, interior equipment, mechanical changes and removal of vehicle components.
Any approved modification must be performed according to the conditions established for the booking.
INSURANCE
REQUIRED COVERAGE MUST
BE IN PLACE BEFORE USE.
Production may be required to provide satisfactory insurance documentation before a vehicle is delivered, transported, operated or otherwise placed under production control.
DAMAGE & CONDITION
PROTECT THE VEHICLE.
Production is expected to exercise reasonable care while a vehicle is under production control.
Any collision, damage, mechanical issue, cosmetic damage, loss, theft or other incident involving the vehicle must be reported promptly.
Responsibility for damage, repair, loss of use, diminished value or related expenses will be determined according to applicable agreements, insurance coverage and the circumstances of the incident.
TRANSPORTATION & DELIVERY
GETTING THE VEHICLE
TO PRODUCTION.
Transportation requirements will depend on the vehicle, location and production.
Owner delivery
Open vehicle transport
Enclosed vehicle transport
Professional towing
Production-arranged transportation
A production should not independently transport or relocate a vehicle unless the transportation method and responsible party have been approved.
SCHEDULE CHANGES & CANCELLATIONS
PRODUCTION SCHEDULES
CAN CHANGE.
Production should notify OCC as soon as possible regarding postponements, cancellations, date changes, location changes or material changes in intended vehicle use.
Availability for a revised date is not guaranteed.
Cancellation fees, transportation expenses, committed costs, hold-day fees or other charges may apply according to the booking terms and timing of the change.
VEHICLE OWNER RIGHTS
OWNERS RETAIN THE RIGHT TO
PROTECT THEIR VEHICLES.
A vehicle owner may establish reasonable restrictions concerning operation, handling, transportation, rigging, modifications and other vehicle use.
If production materially changes the agreed use or creates a condition that may place the vehicle at unreasonable risk, additional approval may be required before continuing.
PRODUCTION RESPONSIBILITY
COMMUNICATE THE
REQUIREMENTS CLEARLY.
Production is responsible for providing accurate information regarding the project, vehicle use, schedule, location, drivers, stunts, rigging, modifications and other material circumstances affecting the vehicle.
Material changes should be disclosed before the vehicle is subjected to the changed activity.
OCC ROLE & LIMITATIONS
OCC FACILITATES THE CONNECTION.
Official Cinema Cars facilitates vehicle sourcing, communication, coordination and related services between productions and vehicle owners.
Unless expressly agreed otherwise in writing, OCC is not the manufacturer, owner, operator, insurer, repairer or transporter of independently owned vehicles represented through its network.
Specific responsibilities of each party may be further defined by booking confirmations, rental agreements, insurance documentation or other written agreements.
RESPONSIBILITY & INDEMNIFICATION
To the extent permitted by applicable law and subject to any controlling written agreement, production may be responsible for claims, losses, liabilities, damages, costs or expenses arising from its possession, operation or authorized use of a vehicle.
Any specific indemnification obligations applicable to a booking may be established in the governing production, rental or vehicle-use agreement.
RESPECT THE VEHICLE.
RESPECT THE AGREEMENT.
By confirming a booking or using a vehicle sourced through Official Cinema Cars, production acknowledges that additional vehicle-specific restrictions, agreements and insurance requirements may apply.
If a booking-specific written agreement conflicts with these general Production Terms, the applicable booking-specific agreement may control to the extent of that conflict.
