VEHICLE OWNER
TERMS

REGISTRATION & ELIGIBILITY

Vehicle owners may submit eligible vehicles to OCC for consideration for film, television, commercial, photography, branded content, music video, event and other production-related opportunities.

OCC reserves the right to accept, reject, suspend, remove or decline to display any vehicle registration at its discretion, subject to applicable law.

Registration with OCC does not create an exclusive relationship unless the vehicle owner separately agrees to exclusivity in writing.

ACCURACY OF INFORMATION

Vehicle owners are responsible for providing accurate, complete and current information regarding each registered vehicle.

This may include:

• Vehicle year, make and model
• Exterior and interior color
• Vehicle condition
• Mechanical condition
• Modifications and aftermarket equipment
• Vehicle location
• Ownership information
• Current photographs
• Special operating or transportation requirements

Owners should promptly notify OCC of material changes that could affect a production's evaluation or use of the vehicle.

OWNERSHIP & AUTHORITY

By registering a vehicle, you represent that you are the vehicle's lawful owner or that you possess sufficient authority from the lawful owner to register the vehicle and authorize its proposed production use.

You are responsible for obtaining any permissions required from co-owners, lienholders, lessors, lenders or other parties whose consent may be required before the vehicle is provided for a production.

OCC may request reasonable documentation regarding ownership or authorization when appropriate.

NO GUARANTEE OF BOOKINGS

Registration makes a vehicle available for consideration but does not guarantee that the vehicle will be requested, selected, booked or used by any production.

Vehicle selection may depend on creative requirements, appearance, availability, location, budget, scheduling, insurance, transportation, production logistics and other considerations outside OCC's control.

OWNER APPROVAL

Unless otherwise agreed in writing, registering a vehicle does not require you to accept a particular production opportunity.

When OCC presents a potential booking, you may evaluate the available details before agreeing to provide your vehicle.

Once you accept a confirmed booking, however, you agree to make reasonable efforts to honor the agreed dates, vehicle availability and other confirmed requirements.

OCC'S ROLE

Official Cinema Cars operates as a vehicle sourcing, coordination and brokerage service connecting vehicle owners with productions and other approved clients seeking vehicles.

Unless expressly stated otherwise in a written agreement, OCC does not itself operate the production and does not control production personnel, filming activities, locations or creative decisions.

The specific contractual relationship for a booking may vary depending on the production and applicable booking documents.

RATES, FEES & COMPENSATION

Compensation is not guaranteed merely because a vehicle is registered with OCC.

For confirmed bookings, rates may vary according to vehicle type, value, rarity, duration, production use, transportation, location, owner attendance and other relevant factors.

Applicable vehicle rates, OCC fees or commissions, reimbursable expenses and payment terms should be established as part of the applicable booking arrangement.

Unless expressly agreed otherwise, owners are responsible for their own taxes and other obligations arising from compensation they receive.

VEHICLE AVAILABILITY

Owners are responsible for communicating accurate availability. A vehicle should not be represented as available for dates on which the owner knows it cannot reasonably be provided.

Production dates and schedules may change. A change to a proposed or previously discussed date does not automatically require the owner to accept the revised date unless otherwise agreed in writing.

APPROVED VEHICLE USE

Vehicle use should remain consistent with the use disclosed and approved in connection with the booking.

Material changes to the proposed use should be communicated and, when appropriate, separately approved before the changed activity occurs.

AUTHORIZED DRIVERS

If the vehicle will be driven, the identity or category of authorized drivers should be established as part of the production arrangement whenever reasonably possible.

Owners may communicate reasonable operating restrictions for specialty, collector, modified, exotic or high-value vehicles.

Talent driving, stunt driving or other specialized operation should not be assumed to be authorized solely because normal driving has been approved.

STUNTS & HIGH-RISK ACTIVITY

Unless specifically disclosed and approved, normal vehicle rental or production use does not constitute authorization for stunt or unusually hazardous activity.

Any approved high-risk use may require separate terms, compensation, insurance, safety procedures or documentation.

RIGGING, DECALS & ALTERATIONS

Production equipment or materials should not be attached to, installed on or applied to a vehicle beyond the scope of the approved use.

This may include:

• Camera mounts
• Suction mounts
• Rigging
• Adhesives and tape
• Temporary decals
• Vinyl graphics or wraps
• Lighting equipment
• Mechanical alterations
• Removal or replacement of vehicle components

Owners should disclose sensitive finishes, paint protection film, vinyl wraps, ceramic coatings, carbon-fiber components or other materials requiring special handling.

INSURANCE REQUIREMENTS

Appropriate insurance documentation may be required before a vehicle is released, transported, driven or otherwise placed under production control.

Insurance requirements may vary depending on the production, vehicle value, proposed use, transportation method and other risk factors.

An insurance certificate alone does not necessarily establish coverage for every loss, driver or activity. Coverage is governed by the applicable insurance policies and endorsements.

TRANSPORTATION

Transportation arrangements should be established before the vehicle is moved whenever reasonably possible.

Depending on the booking, vehicles may be owner-delivered, driven, towed, transported on an open carrier or transported using an enclosed carrier.

Owners are responsible for communicating special loading, clearance, suspension, towing, tie-down or transportation requirements applicable to their vehicles.

VEHICLE CONDITION

Owners are encouraged to document the condition of the vehicle before releasing it for a production.

Photographs or video may be useful for documenting existing scratches, wheel damage, body damage, interior condition, mileage and other relevant conditions.

Owners should disclose known mechanical or safety conditions that could reasonably affect operation, transportation or production use.

DAMAGE & INCIDENT REPORTING

Vehicle damage, collisions, theft or other significant incidents should be reported promptly to the appropriate production representative and OCC.

Owners should reasonably cooperate with documentation, insurance and claims procedures applicable to the incident.

Responsibility for repair costs, deductibles, loss of use, diminished value, transportation or other claimed losses will depend on the applicable agreements, insurance coverage and circumstances of the particular incident.

PERSONAL PROPERTY

Owners should remove valuables and unnecessary personal property from the vehicle before delivering it for production.

OCC is not responsible for personal property left inside or attached to a vehicle except to the extent liability cannot lawfully be excluded.

CANCELLATIONS

Production schedules are subject to change, postponement or cancellation.

Any cancellation fee, kill fee, reimbursement or other payment due following cancellation will be determined by the terms applicable to the particular confirmed booking.

If an owner becomes unable to provide a confirmed vehicle, the owner should notify OCC as soon as reasonably possible.

PHOTOGRAPHS & REGISTRY MATERIALS

By submitting vehicle photographs and related materials to OCC, you represent that you have the right to provide those materials for registry and vehicle-sourcing purposes.

You grant OCC a non-exclusive, revocable, royalty-free license to store, reproduce and display submitted vehicle photographs and registration information as reasonably necessary to operate the registry, present the vehicle to prospective production clients, and administer potential or confirmed bookings.

This license does not transfer ownership of your photographs or vehicle to OCC.

PRODUCTION PHOTOGRAPHY & FOOTAGE

The appearance of a vehicle in finished production photography, footage, advertising or other media may be governed by the applicable production agreement, release or booking documents.

Unless expressly agreed otherwise, vehicle owners should not assume that ownership of a vehicle provides ownership of or approval rights over footage or photographs created by a production.

OWNER RESPONSIBILITIES

Vehicle owners agree to act reasonably and professionally in connection with accepted production opportunities.

Owners are responsible for:

• Providing accurate registration information
• Communicating vehicle limitations
• Disclosing known material safety or mechanical concerns
• Providing the vehicle as agreed for confirmed bookings
• Following applicable production and location procedures
• Communicating changes in availability promptly
• Providing required ownership or payment documentation

INDEPENDENT RELATIONSHIP

Unless a separate written agreement expressly provides otherwise, registration with OCC does not create an employer-employee relationship, partnership, joint venture, franchise or agency relationship between OCC and a vehicle owner.

Vehicle owners remain responsible for their own business, tax, licensing and other legal obligations applicable to compensation they receive.

THIRD-PARTY PRODUCTIONS

Productions, transportation providers, insurers, locations and other service providers may be independent third parties.

OCC does not guarantee the acts, omissions, financial condition, insurance coverage or performance of independent third parties.

Nothing in these terms limits any responsibility that OCC has under applicable law or a separate written agreement.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, OCC will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising solely from use of the OCC registry or from a failure to receive a production opportunity.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold OCC harmless from third-party claims, liabilities, losses and reasonable expenses arising from your material breach of these Vehicle Owner Terms, your material misrepresentation regarding ownership or authority, or your unlawful conduct.

Any indemnification obligations relating to a particular production booking may also be governed by separate written agreements.

REMOVAL FROM THE REGISTRY

Vehicle owners may request removal of a vehicle from active consideration, subject to any obligations arising from an already confirmed booking.

OCC may suspend or remove registrations that contain materially inaccurate information, involve ownership disputes, create safety concerns, violate these terms or otherwise cannot reasonably remain in the registry.

PRIVACY

Information submitted through OCC is handled in accordance with the applicable OCC Privacy Policy.

Certain vehicle and owner information may be shared with prospective or confirmed production clients when reasonably necessary to evaluate, coordinate or administer a vehicle opportunity.

CHANGES TO THESE TERMS

OCC may update these Vehicle Owner Terms from time to time. The current version may be posted on the OCC website with an updated effective date.

Where required by applicable law, OCC will provide additional notice or obtain additional consent before materially revised terms become binding.

GOVERNING LAW

Except where applicable law requires otherwise, these Vehicle Owner Terms will be governed by the laws of the State of California, without regard to conflict-of-law principles.

Any venue, dispute-resolution or arbitration provisions applicable to a specific booking may be stated in the corresponding written agreement.

ACCEPTANCE

By submitting a vehicle registration to OCC or continuing to maintain an active registration after receiving legally sufficient notice of these terms, you acknowledge your agreement to the applicable Vehicle Owner Terms.

Specific production bookings may require additional agreements, releases, insurance documentation or other written approvals before the vehicle is provided.
