TERMS OF
SERVICE
These Terms of Service govern access to and use of the Official Cinema Cars website, vehicle registry, production sourcing services and related features, communications and services.
PLEASE READ THESE
TERMS CAREFULLY.
By accessing or using the Official Cinema Cars website or services, you agree to these Terms of Service and any additional terms that apply to a particular service, registration or production booking.
If you do not agree to these terms, you should not use the applicable OCC services.
ABOUT OFFICIAL CINEMA CARS
Official Cinema Cars ("OCC," "we," "us," or "our") provides vehicle registry, sourcing, coordination and related services intended to help connect vehicle owners with production companies and other approved clients seeking vehicles for professional projects.
Projects may include film, television, commercials, photography, branded content, music videos, events and other entertainment or production-related uses.
ELIGIBILITY
You may use OCC only if you are legally capable of entering into the agreements applicable to your use of the service.
If you use OCC on behalf of a company, production, organization or vehicle owner, you represent that you have authority to act on behalf of that party in connection with the applicable request or transaction.
USE OF THE WEBSITE
You may use the OCC website for lawful purposes related to OCC's services.
You agree not to:
- Use the website for unlawful or fraudulent activity
- Submit knowingly false or misleading information
- Attempt unauthorized access to OCC systems or data
- Interfere with website operation or security
- Upload malicious code, viruses or harmful material
- Impersonate another person or organization
- Harvest information from the website without authorization
- Use automated systems in a manner that materially disrupts the service
VEHICLE REGISTRY
OCC may allow vehicle owners or authorized representatives to submit vehicles for inclusion in the Official Cinema Cars vehicle registry.
Submission of a vehicle does not guarantee approval, publication, production selection, rental, compensation or any other opportunity.
OCC may review, organize, categorize, suspend or remove vehicle listings in accordance with its operating procedures and applicable law.
VIEW VEHICLE OWNER TERMS →PRODUCTION SERVICES
Production clients may contact OCC to request assistance identifying, sourcing or coordinating vehicles for professional projects.
Vehicle availability, pricing, insurance requirements, transportation, usage restrictions and other booking conditions may vary by vehicle and project.
A website inquiry alone does not create a confirmed booking. A production booking is confirmed only in accordance with the applicable booking process and written terms.
VIEW PRODUCTION TERMS →OCC'S ROLE
OCC acts as a vehicle sourcing, coordination and brokerage service. The precise role OCC performs may vary according to the particular project or written booking arrangement.
Unless expressly agreed otherwise in writing, OCC does not operate or control an independent production, production company, transportation provider, location, insurer or other third-party service provider.
NO GUARANTEE OF AVAILABILITY
Vehicle listings, photographs or registry information do not guarantee that a vehicle will be available for a particular date, project, location or proposed use.
Vehicle availability should be confirmed through OCC before a production relies upon a particular vehicle.
NO GUARANTEE OF BOOKINGS
OCC does not guarantee that a registered vehicle will receive inquiries, bookings, rentals, compensation or exposure in any particular production.
Production selection may depend on creative, logistical, financial, scheduling, insurance and other factors outside OCC's control.
INFORMATION YOU PROVIDE
You are responsible for the accuracy of information you submit to OCC.
You agree not to knowingly submit materially false, misleading, unauthorized or fraudulent information.
You should promptly update or notify OCC regarding material changes to information that could affect an active registration, request or confirmed booking.
USER-SUBMITTED CONTENT
You may submit photographs, vehicle information, descriptions, documents and other materials in connection with OCC services.
You retain ownership of content you own. By submitting content, you grant OCC a non-exclusive, royalty-free license to store, reproduce, display and transmit that content as reasonably necessary to operate the service, evaluate submissions, communicate with potential production clients and administer opportunities or bookings.
You represent that you have the rights or authorization necessary to submit the material for these purposes.
OCC CONTENT & INTELLECTUAL PROPERTY
The OCC website and its original branding, graphics, design, layout, text, logos, databases, software and other proprietary materials may be protected by copyright, trademark and other intellectual property laws.
Except as permitted by law or authorized in writing, you may not reproduce, distribute, sell, modify or commercially exploit OCC proprietary content.
VEHICLE PHOTOGRAPHS
Vehicle photographs displayed through OCC may belong to OCC, vehicle owners, photographers or other rights holders.
Display of an image on the OCC website does not grant website visitors permission to copy, publish, sell or commercially use that image.
PRICING & QUOTES
Rates, estimates and quotes may depend on the specific vehicle, project, duration, usage, location, transportation requirements, insurance requirements and other factors.
Unless expressly stated otherwise, preliminary discussions, website information or estimates do not constitute a guaranteed final price.
PAYMENTS
Payment requirements for confirmed bookings or other paid services will be governed by the applicable invoice, booking confirmation, agreement or other written terms.
Users are responsible for providing accurate billing and payment information when payment is required.
INSURANCE
Production vehicle use may require appropriate insurance before a vehicle is released, transported, operated or otherwise placed under production control.
Insurance requirements may vary according to the vehicle, production and proposed use.
A certificate of insurance does not itself guarantee coverage for every activity or loss. Actual coverage is governed by the applicable insurance policies and endorsements.
VIEW INSURANCE REQUIREMENTS →TRANSPORTATION
Vehicle transportation arrangements may vary by booking and may include owner delivery, production pickup, towing, open transport or enclosed transport.
Specific transportation responsibilities and costs should be established in connection with the applicable booking.
THIRD-PARTY SERVICES
OCC may interact with independent productions, transportation companies, payment providers, insurers, technology providers and other third parties.
Independent third parties may have their own terms, privacy practices, insurance requirements and operating procedures.
OCC does not control independent third parties merely because OCC facilitates an introduction or coordinates a service.
THIRD-PARTY LINKS
The OCC website may contain links to websites or services operated by independent third parties.
OCC is not responsible for the content, security, availability, privacy practices or terms of independent third-party websites.
PRIVACY
OCC's collection and processing of personal information is described in our Privacy Policy.
VIEW PRIVACY POLICY →WEBSITE AVAILABILITY
OCC may modify, update, suspend or discontinue website features from time to time.
We do not guarantee uninterrupted or error-free access to the website.
Maintenance, technical problems, third-party services, security issues and circumstances outside OCC's reasonable control may affect website availability.
SECURITY
Users must not attempt to bypass, disable, probe or interfere with website security features or gain unauthorized access to OCC systems, accounts, databases or information.
If you believe you have discovered a security issue affecting OCC, contact us rather than attempting to exploit or publicly expose the issue.
SUSPENSION OR TERMINATION
OCC may restrict, suspend or terminate access to services when reasonably necessary to address fraud, abuse, safety concerns, unlawful activity, material violations of these terms or risks to OCC, users or third parties.
Vehicle owners may also request removal of their vehicle from active registry consideration, subject to obligations arising from any already confirmed booking.
DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the OCC website and general registry services are provided on an "as available" basis.
OCC does not warrant that the website will always be uninterrupted, error-free or free from all harmful components.
OCC does not guarantee that use of the website will result in a production booking, particular financial result or specific business opportunity.
Nothing in these terms excludes warranties or rights that cannot lawfully be excluded.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, OCC will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising solely from use of or inability to use the general OCC website or registry.
Nothing in these Terms of Service excludes or limits liability that cannot legally be excluded or limited.
Liability relating to a specific vehicle booking, production use, transportation arrangement, payment or damage claim may be governed by additional written agreements and applicable insurance coverage.
INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold OCC harmless from third-party claims, liabilities, losses and reasonable expenses arising from your material breach of these Terms of Service, your unlawful use of the service, or your material infringement of another party's rights.
Additional indemnification provisions may apply to specific vehicle bookings under separate written agreements.
FORCE MAJEURE
To the extent permitted by applicable law and applicable agreements, OCC will not be responsible for delays or failures caused by events beyond its reasonable control.
Such events may include severe weather, natural disasters, governmental actions, labor disruptions, widespread technology failures, transportation disruptions or other extraordinary circumstances.
GOVERNING LAW
Except where applicable law requires otherwise, these Terms of Service will be governed by the laws of the State of California, without regard to conflict-of-law principles.
Specific production agreements may contain additional dispute-resolution or venue provisions.
SEVERABILITY
If a provision of these Terms of Service is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
NO WAIVER
OCC's failure to enforce a provision of these terms on one occasion does not necessarily constitute a waiver of the right to enforce that provision later.
ADDITIONAL TERMS
Certain OCC services or transactions may be governed by additional terms.
CHANGES TO THESE TERMS
OCC may update these Terms of Service from time to time to reflect changes to our services, business practices or legal requirements.
The effective date displayed on this page may be updated when revisions are made.
Where required by applicable law, additional notice or consent will be provided before material revised terms become binding.
